Notice is given in accordance with Section 19(1) of the Education and Inspections Act 2006 and section 5(1) of the School Organisation (Prescribed Alterations to Maintained Schools)(England) Regulations 2013 that Wirral Council (‘the Council’) is proposing to make a prescribed alteration to Bidston Avenue Primary School, 100 Tollemache Road, Birkenhead, CH41 0DQ (‘the School’) which is a community primary school, as follows:

  • Change the lower age limit of the School from 4 years to 3 years so as to offer maintained nursery provision with effect from 1st September 2021. The current age range is 4 to 11. The proposed age range is 3 to 11.

The School currently offers 3 year old provision as a Governor-led, non-maintained pre-school, “BiddyAve Buddies”. Under this proposal, the early years provision would become maintained along with the rest of the school. This would enable the School to improve communication and administration and bring the pre-school currently on site under the school umbrella as a maintained Nursery class. This would have no impact on the amount of early years places provided.

“BiddyAve Buddies” has been a popular provision within the local community who have shown the demand for early years places on the School’s site. Integrating into the school will allow children in attendance to be registered as pupils of the School. This would enable the School to improve communication and administration and adopt a cohesive and consistent approach to learning right through to Year 6.

There would be no change to the number or location of places to be offered. The proposal would not alter the School’s admission number for Foundation 2, or the School’s admission arrangements. Attending a particular nursery or pre-school does not give any priority for admission to Bidston Avenue Primary School in Foundation 2, and parents of nursery aged children would continue to need to apply in the usual way for admission to primary/infant schools.

There should not be any impact on other educational institutions locally or on traffic in the area as no additional places are being introduced. The accommodation previously occupied by BiddyAve Buddies will be used by the maintained nursery provision and there are no direct project costs associated with this proposal.

Within four weeks of the date of publication of this notice, any person may object to, comment on or make representations regarding this proposal by submitting an email to primaryplaces@wirral.gov.uk – please put “Bidston Avenue Comment” in the subject; or by post to:

All comments, objections and representations must be received by 19h August 2021. The Council will then take all views into consideration and make a determination regarding the proposal within 2 months.  If the Council does not make a determination within 2 months, the decision will be made by the Schools Adjudicator.

Consultation on change of age range at Bidston Avenue Primary School

Wirral Council is proposing to amend the age range of Bidston Avenue Primary School from 4 to 11 to 3 to 11. The proposal has met the criteria for a change of age range and the school have consulted all stakeholders with due diligence.

The school currently offers 3 year old provision as a Governor-led, non-maintained pre-school, “BiddyAve Buddies”. Under this proposal, the early years provision would become maintained along with the rest of the school. This would enable the school to improve communication and administration and bring the pre-school currently on site under the school umbrella as a maintained Nursery class. A Governor-led pre-school is a setting that is managed directly by the Governing Body. Unlike maintained nursery provision, children are not registered pupils of the school and provision is managed separately by the Governing Body.

If you would like to make a comment of support or objection, a four week representation period starts on 22 July 2021 and ends at 5pm on 19 August 2021. A formal public notice has been issued at the school and in the local area.

What happens next

At the end of the 4 week period, the Local Authority will consider evidence including any responses received. The Council’s Decision Maker will decide whether or not to proceed with the proposal.
