Statutory obligations for trees

The Local Planning Authority's consent is not required for carrying out works to protected trees if it is in compliance with a statutory obligation.

These can include those working on behalf of:

  • railways
  • water transport
  • canals
  • gas and electricity operators
  • water and sewerage
  • telecommunications

This applies if the work is in the interest of safety or involves the inspection, repairing or renewing of apparatus.

However, there is normally an obligation to replant any trees if:

  • you cut down or destroy a protected tree
  • you are in breach of an order
  • the council instructs you to do so as a condition of its consent
