Erecting a hoarding or scaffold on a public road or pavement

Anyone intending to erect a scaffold or a hoarding, which encroaches on to a public road or pavement, is required under Section 169 of the Highways Act 1980 to obtain a licence from the Council. If permission is granted a licence will be issued together with a schedule of conditions that must be adhered to.

The Council will consider applications based upon the scale and extent of works being undertaken and the existing site, highway and traffic conditions. In some circumstances the Council can refuse to issue a licence in the interests of public or highway safety. It is an offence, for which the Council may prosecute, if you erect a scaffold or hoarding on the footway or highway without a licence.

We aim to process applications within 5 working days. In the interests of highway safety tacit consent does not apply and hoarding or scaffold should not be placed on the highway until consent has been granted. Application fees

There is a fee of £50.00 for each licence application and this must be paid at the time that you apply

Applying for and the granting of a licence

You will need to complete an application form providing details of where, when, why and for how long you intend to occupy the highway with a hoarding or scaffolding.

The following supporting documents must be provided with your application:

  • A scale site and location plan showing the extents of the scaffolding/hoarding
  • A copy of your current certificate for Public Liability Insurance covering this type of work
  • Proof of the scaffold erectors accreditation

If you feel your application has been unreasonably withheld or you are in disagreement with the conditions attached with the licence please contact Streetscene in the first instance. Alternatively you may appeal through the Magistrates Court.
