Action taken against anti-social behaviour

Wirral Anti-Social Behaviour Team, in partnership with landlords, Wirral Partnership Homes and Beechwood & Ballantyne Community Housing Association, have been tackling anti-social behaviour and protecting communities.
Below are summaries of four recent cases:
Case 1: Eviction for Birkenhead man
Action was taken against Ian Mansell of Houghton Road, by Wirral Anti-Social Behaviour Team on behalf of his landlord, following his conviction for the offences of criminal damage and harassment. He was sentenced to three months’ imprisonment, suspended for two years.
Two months’ notice was served on the 30-year old probationary tenant of Wirral Partnership Homes. Mansell failed to comply with the notice and proceedings for his eviction were commenced. At Birkenhead County Court on July 2nd 2008 an immediate eviction order was made.
Case 2: Eviction for Wallasey attempted burglary man
Action was taken against Kevin Willers of King Street, following his arrest for attempted burglary with intent to steal in relation to an 83-year old neighbour.
An application was made against Willers for an Anti-Social Behaviour Injunction by Wirral Anti-Social Behaviour Team on behalf of his landlord, Wirral Partnership Homes. At Birkenhead County Court on June 13th 2008, an interim injunction was issued against the 49-year old.
The interim injunction was extended and an application made against Willers for his eviction from his home.
On March 3rd 2008 at Liverpool Crown Court, Willers was found guilty of the offence of attempted burglary with intent to steal and sentenced to 15 months’ imprisonment.
On Monday 23rd June 2008 at Liverpool County Court following a full trial, an immediate eviction order was issued against Willers, who had been released from custody on 20th June due to time already served.
Case 3: Injunction for Ballantyne knife man
Action was taken against John Jones of Ballantyne Drive following threatening behaviour towards residents.
Action was taken against the 67-year old following an alleged incident on June 9th 2008 whereby Jones was alleged to have been in the road outside his house and threatening to stab and shoot residents and nearby children attending Ballantyne Community Centre. Jones, who was in a wheelchair, also pulled a knife from his shorts, shouting further threats.
An application was made by Wirral Anti-Social Behaviour Team on behalf of Jones’ landlord, Beechwood & Ballantyne Community Housing Association, and on June 24th 2008, a 2-year Anti-Social Behaviour Injunction was issued against him.
Under the terms of the injunction, Jones was banned from being in possession of a knife outside his home or in the locality of Ballantyne Community Centre. He was also ordered not to threaten to use or use violence against any persons residing in, visiting or otherwise engaging in a lawful activity in the locality of the community centre. He was also ordered not to use foul and abusive language or gestures towards any persons residing in, visiting or otherwise engaging in a lawful activity in the locality of the Community Centre.
Jones was also banned from harassing or intimidating any persons residing in, visiting or otherwise engaging in a lawful activity in the locality of the Community Centre and from damaging property not belonging to himself in the locality of the Community Centre. He was also forbidden from entering the Community Centre located on Ballantyne Drive.
The injunction was later served on Jones who did not attend court and remains in force until June 23rd 2010. If breached and proven, Jones faces up to two years’ imprisonment for contempt of court.
Further action against Jones may be taken.
Case 4: Eviction Order for Bromborough family
Action was taken against Jean Cairns of Acre Lane following a long history of complaints about anti-social behaviour in relation to her sons, Michael, 17, and Christopher, 18.
Cairns was originally subject to an eviction order suspended on condition she complied with the terms of her tenancy agreement on June 1st 2005.
On February 4th 2008, Wirral Anti-Social Behaviour Team wrote to Cairns on behalf of her landlord, Wirral Partnership Homes, stating that a warrant for her eviction was to be sought following a number of incidents of anti-social behaviour related to her two sons. Cairns’ neighbours stated that the situation had improved recently and they did not wish to make any complaint in respect of her tenancy.
At Birkenhead County Court on June 12th 2008, Cairns, 44, was issued with a further eviction order postponed for two years on condition that she complied with the terms of her tenancy agreement in relation to anti-social and criminal behaviour.
The eviction order remains in force until June 11th 2010.
Caroline Laing, Manager of Wirral Anti-Social Behaviour Team, said: “Anti-social behaviour is unacceptable and simply will not be tolerated.”
Brian Simpson, Chief Executive of Wirral Partnership Homes, added: “We will continue to do everything we can to protect tenants and residents within our communities.”
Andy Hall, Chief Executive of Beechwood & Ballantyne Community Housing Association, said: “We will not allow the minority of anti-social individuals to negatively impact on the majority of law abiding citizens.”
