Enforcement Of Planning Control

The Council has legal powers to act if development is carried out without planning permission or conditions attached to a permission are not complied with. The Council may serve an enforcement notice requiring the works to be remedied. There is a right of appeal against an enforcement notice, similar to the appeal procedure against refusal of planning permission.

The Protection Of Trees

Tree protection is an important planning function, although not every tree is protected. The Council has powers to preserve individual trees, groups of trees, and even woodlands, if it is appropriate, but it does not protect hedgerows. Tree Preservation Orders (TPOs) are to protect trees; these Orders prevent a tree from being felled, lopped, topped or wilfully destroyed without permission. Fines can be levied for ignoring this protection. If you are in any doubt whether or not a tree is protected by a TPO, please check with the Planning Department. It is recognised that proper tree management is essential to the effective preservation of protected trees. If you think you need to do work on a protected tree, make sure that:

  • you obtain the necessary permission from the council
  • you employ a qualified tree surgeon to do the work

Access For The Disabled

The Council is committed to helping people with one or more forms of disability to lead independent lives. All new buildings used by the public as customers, clients, employers or visitors should make suitable provision for disabled people. Proposals for extensions and changes of use to existing buildings should make similar provision, where practicable. This may include reserved car parking, ramps to entrances, easy movement within buildings and special toilet facilities. Many of these features would also help frail, elderly people and parents with young children.
